Re: Your application for access to documents - 2026/4751
Dear Sir or Madam,

I acknowledge receipt of your letter Ref. Ares(2026)10038762 of 26 October 2026 and of the three enclosed
documents. Thank you for the reply and for consulting the Polish Managing Authority. I do not intend to make
a confirmatory application.

May I ask you to forward the following short remark to the unit responsible for the Polish AMIF programme
(CCI 2021PL65AMPR001)? It is not part of the access request.

Your letter confirms that no document or discussion has so far addressed an indicator on the duration of
residence procedures under Article 33(5) of Regulation (EU) 2021/1147. The three observation letters ask
Poland mainly to speed up implementation and absorption. Spending faster is not, in itself, the result that
matters to the people concerned. The result is a decision on a residence permit within the time limit set by
Polish law, which is 60 days for a temporary residence permit (Article 112a(1) of the Act on Foreigners).

The situation is deteriorating quickly. According to the Polish Office for Foreigners, the number of pending
temporary residence cases in the 16 voivodeship offices rose from 387,312 at the end of 2023 to 646,232 at
the end of 2025 and 803,223 on 1 July 2026. According to the Ministry of the Interior, the average duration of
these proceedings in mid-2026 ranged from 242 to 658 days depending on the region. The rules of the 2026
call for the voivodeship offices already use "the average duration of proceedings in the voivodeship office" as
a key for dividing the allocation, so the figure exists. It is simply not reported as a result.

Because the power under Article 33(5) is limited in time by Article 37(2), I would respectfully suggest that the
Commission begin this assessment now, rather than at the performance review.

Yours faithfully,
